Booking Terms, Conditions
& Waiver

The fine print for the best weekend of the year. This document outlines the terms and conditions for booking and attending the Death & Co Annual Meeting — a private, invitation-style retreat at the Four Seasons Hotel Chicago, November 20–22, 2026.

The Event is hosted by Death & Co (operated by Gin & Luck, Inc.). Everyday Travel LLC (“Everyday”) acts as the ticketing and registration platform on behalf of Death & Co. By completing a purchase, you agree to the terms below.

1. Agreement & Acceptance

By making a booking, you accept all of the terms in this agreement and authorize Death & Co and Everyday to perform services on your behalf. All persons named in your booking (“Participants”) are subject to this agreement. By making a booking, you affirm that you have made all other Participants listed in the booking aware of these terms and that all Participants accept these terms, regardless of who makes payment.

2. Payment & Booking

Currency & Processing

All payments must be made in United States dollars (USD) and are processed through Stripe. Your payment statement will show “Death & Co.”

Booking Confirmation

Your booking is confirmed once you receive a confirmation email. Space is limited and confirmed only upon successful payment. We reserve the right to decline any booking for any legitimate reason.

Non-Refundable Booking Deposit

A non-refundable deposit is required at the time of registration to reserve your place at the Event. This deposit confirms your participation, removes a limited guest space from availability, and allows us to make advance, non-recoverable commitments to our venue, partners, programming, and hospitality arrangements. Accordingly, the booking deposit is non-refundable if you cancel for any reason and is applied to unrecoverable costs including those above, service fees, and payment processing fees.

Remaining Balance

The remaining balance will be charged at a later date as communicated during registration. If payment is not received when due, we reserve the right to cancel your booking and apply cancellation fees in accordance with this policy.

3. Cancellations, Transfers & Refunds

No Refunds

All ticket purchases and deposits are non-refundable. This includes both the deposit and the full ticket price. There are no exceptions to this policy, including for reasons related to weather, personal, family, or medical emergencies, or any other circumstances beyond our control.

Transfers

Tickets are transferable. At our discretion, we may allow a one-time transfer of your booking to another individual, provided your request is made at least 14 days before the Event by contacting concierge@deathandcompany.com. Membership bundle transfers are subject to Death & Co’s membership transfer policies.

Event Credits

If you are unable to attend and do not wish to transfer your ticket, your purchase may be applied as an Event Credit toward a future Death & Co experience at our discretion. If the price of the future experience differs from your original purchase, the difference will be charged or credited only once dates are confirmed and you have agreed to proceed.

Event Credit terms:

• Event Credits are non-refundable and non-transferable.
• Event Credits have no cash value and cannot be exchanged for money.
• Event Credits must be redeemed within 24 months of issuance.
• Event Credits cannot be used after the expiration date.
• Event Credits may be redeemed for future Death & Co experiences, events, or at Death & Co locations (subject to availability and venue policies).
• Event Credits are the property of Death & Co and cannot be bought or sold.

Death & Co reserves the right to refuse, void, cancel, or hold for review any Event Credit at its discretion. By accepting an Event Credit, you agree that it is in lieu of any refund you might be entitled to receive, and you release Death & Co and Everyday from any claims relating to the original booking or any refund or compensation you might otherwise be entitled to.

No Refund for Unused Portions

Once the Event has started, no refunds will be provided for any reason for any unused portion, including if you leave early or are asked to leave. The ticket price is a package cost.

4. Cancellation or Changes by Organizers

Death & Co and Everyday reserve the right to cancel, alter, or modify the Event prior to its start date for any reason, including insufficient registrations or reasons beyond our control. We reserve the right to substitute venues, restaurants, speakers, activities, or other services with comparable alternatives if necessary to operate the Event.

Foreseeable Cancellations

If the Event is canceled for foreseeable reasons, we will work with you to explore options including transferring your booking to a future event, converting to event credit, or issuing a refund to the original payment method. A refund of payments made will constitute full settlement of any claims.

Force Majeure

Death & Co and Everyday will not be deemed in breach of this agreement by reason of delay or nonperformance due to Force Majeure — circumstances beyond reasonable control, including but not limited to acts of God, terrorist activities, insurrection, flood, fire, war or threat of war, civil disturbance, labor strikes, sickness, quarantine, pandemic, government intervention, weather conditions, and unforeseen circumstances. In such event, your booking will transfer to the rescheduled date if applicable, or you may keep 100% of your booking value as event credit valid for 24 months. If you elect to cancel, standard terms apply.

5. Membership Bundles

Certain ticket tiers include a Death & Co membership. If you purchase a membership bundle:

• The membership is administered by Death & Co (Gin & Luck, Inc.) through The Third Place, Inc. (“TTP”).
• You will be asked to agree to the applicable membership agreement during checkout:
  • Out of Town Membership Agreement (for the OOT bundle)
  • Local Membership Agreement (for the Local bundle)
• You will also be asked to agree to the TTP Terms of Service and TTP Privacy Policy, which govern the membership platform.
• Membership activation occurs after the Event and is subject to the terms of the applicable Membership Agreement.
• The ticket and membership components of a bundle purchase cannot be separated after purchase.
• The membership initiation fee portion is non-refundable once membership activation has been initiated with TTP.

6. Attendee Code of Conduct

By registering, you agree to the following:

• Respect & Conduct: You will respect local laws and customs, the rights and privacy of fellow attendees, and the staff and venues hosting the Event.
• Health & Dietary Needs: You will share any relevant medical conditions, mobility limitations, or dietary restrictions at least 14 days prior to the Event. We will make reasonable efforts to accommodate requests but cannot guarantee that all can be met.
• Personal Responsibility: You are responsible for managing your own participation. Event staff and partners cannot provide physical mobility assistance or personal care.
• Safety & Group Well-Being: Death & Co may, in its sole discretion, refuse service or remove a Participant whose health or conduct poses a risk to themselves or others, or materially impacts the experience of the group. No refund will be issued in such cases.

7. Alcoholic Beverages

The Event includes alcoholic beverages as part of the programming. By attending, you confirm that you are at least 21 years of age and voluntarily assume all risks associated with the consumption of alcohol. You agree to drink responsibly. Death & Co reserves the right to refuse service of alcohol to any attendee at its sole discretion.

8. Health & Medical

By registering, you represent that you do not have any physical or other conditions that would create a hazard for you or other Participants. You must inform us of any conditions that require special attention at the time of booking. We reserve the right to accept, decline, or remove anyone from the Event who we judge to be incapable of participating safely.

You certify that you have adequate insurance to cover any injury or damage you may cause or suffer while participating, or else you agree to bear the costs yourself. Death & Co and Everyday are not responsible for costs associated with medical care, transportation, or related expenses.

9. Images & Media Release

You agree that Death & Co, Gin & Luck, Inc., Everyday Travel LLC, and their contractors and suppliers (collectively, the “Organizers”) may use, re-use, and reproduce any images, photos, or videos that you send to us, or that are taken by our staff, contractors, photographers, and/or other attendees of you individually or in a group, in any medium — including but not limited to print, electronic media, internet, social media, live streams, audio recordings, and video — free of charge and without your right to inspection, for promoting and publicizing Death & Co experiences and services worldwide.

By registering and attending, you grant the Organizers an irrevocable, royalty-free, worldwide, perpetual license to use your name, likeness, image, voice, and statements for the purposes of:

• Event documentation and recap content
• Promotional materials for future Death & Co experiences
• Marketing across Organizer-owned channels (websites, newsletters, social media, advertising)
• Press and editorial coverage

This license does not require additional compensation or approval. All original photographs, video footage, and audio recordings captured at the Event are the sole property of the Organizers and may not be reproduced, distributed, or used commercially by attendees without prior written consent.

If you do not wish to be photographed or filmed, you must inform us or your Event host in writing at concierge@deathandcompany.com at least 7 days prior to the Event, or at the start of the Event. We will make reasonable efforts to accommodate your request, but cannot guarantee complete exclusion from all media captured in shared event spaces.

10. Acknowledgement & Assumption of Risk

You are voluntarily participating in the Event, which will involve a variety of activities depending on the programming, including but not limited to: cocktail programming, tastings, guided tours, dining experiences, walking tours, bar crawls, social gatherings, and other outdoor or indoor activities (collectively, “Activities”). You understand that this list is not exhaustive of all Activities that may be made available to you.

You acknowledge that you are voluntarily participating with knowledge that the Event involves risks and dangers including, but not limited to: risks inherent in Activities; consumption of alcoholic beverages; food allergies or dietary reactions; physical exertion for which you may not be prepared; transportation to and from venues; weather conditions; forces of nature; contact with other attendees; emotional responses; accident or illness; the adequacy of medical attention once provided; stolen, lost, or misplaced personal property; and any actions, omissions, or conditions outside of the Organizers’ control not mentioned herein.

You understand that such risks cannot be eliminated without jeopardizing the essential qualities of the Event. You expressly agree to be responsible for your own welfare and fully assume all of the above risks, as well as all other risks both known and unknown, voluntarily and knowingly, to the fullest extent permitted by law.

11. Waiver of Liability, Release, Indemnification & Covenant Not to Sue

To the fullest extent permitted by law, you, for yourself, your heirs, legal and personal representatives, next of kin, including your spouse, successors, and assigns (individually and collectively, “Releasors”), expressly release, waive, forever discharge, hold harmless, and covenant not to sueDeath & Co, Gin & Luck, Inc., Everyday Travel LLC, and their respective owners, shareholders, officers, employees, directors, representatives, volunteers, guides, local operators and suppliers, successors, and assigns (individually and together, “Released Parties”) from and against any and all liability, claims, causes of action, demands, costs, damages, losses, or suits of any and every kind which you now have or may later have against the Released Parties arising out of, relating to, or in connection with the Event arranged through or provided by the Organizers, whether arising from the Released Parties’ negligence or otherwise.

In addition, you agree to fully indemnify (that is, protect and defend, and satisfy claims against) and hold harmless each Released Party from any and all claims, actions, suits, and demands (including all reasonable attorney’s fees and costs incurred by the Released Party) initiated by a third party and arising from, attributable to, or related to your negligent or intentional actions or inactions, whether arising from the Released Parties’ negligence or otherwise, occurring during the Event.

You agree that the terms of this agreement shall serve as a complete release and express assumption of risk for yourself, all members of your family, and all persons traveling with you or on whose behalf you are accepting this agreement, your and their heirs, as well as your and their next of kin, successors, assigns, and legal and personal representatives. It is your intention to fully assume all risks associated with the Event and to release the Released Parties from any and all liability to the maximum extent permitted by law.

12. Limitation of Remedies

You agree that the sole remedy for any default by the Organizers arising under this agreement shall be the return of the paid ticket cost. To the maximum extent permitted under applicable law, the Organizers shall not be liable for any special, consequential, indirect, incidental, or other damages, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise. You expressly waive any right to recover such damages.

13. Travel Insurance

Travel insurance is not included in your ticket cost. Because the Event involves advance, non-refundable commitments, we strongly recommend that all Participants carry comprehensive travel insurance. Your policy should include coverage for trip interruption and cancellation, medical expenses, accident/life, and other expenses which might arise as a result of loss, damage, injury, delay, or inconvenience.

If you cancel your booking, or the Organizers cancel, reschedule, or modify the Event, travel insurance is the primary means of protection for costs not otherwise refundable under these terms. You agree to assume all costs of medical care, transportation, and related costs. The Organizers are not responsible for losses that may be covered by insurance.

The Organizers are not responsible for costs incurred in preparing for travel (e.g., flights, ground transportation) or arrangements made independently. We recommend purchasing refundable airfare. By booking, you acknowledge responsibility for obtaining adequate coverage.

14. Credit Card Authorization

You authorize the Organizers to charge your credit card for any cancellation fees, supplemental payments, or outstanding balances that you incur post-booking.

15. Inclusions & Exclusions

What’s Included

Your ticket includes services specified on the Event page, such as hotel accommodations at the Four Seasons Chicago, specified meals and dining experiences, cocktail programming, and guided activities as stated.

What’s Not Included

Unless specifically stated, ticket prices do not include:

• Flights or ground transportation to and from Chicago
• Transportation not listed in the itinerary
• Meals and services not listed as included
• Personal expenses during leisure time
• Travel insurance, medical coverage, and evacuation services
• Gratuities beyond those included in the programming
• Other personal expenses

Inclusions vary by ticket tier. Your ticket confirmation and pre-event materials are the best source for what is included.

Pricing

Ticket prices are subject to change without notice until your booking is confirmed. Different Participants may have paid different prices depending on booking timing or promotions available at the time. Discounts or reduced pricing that become available after you book will not apply retroactively.

16. Pre-Event Documentation

Please carefully read all Event-related documents that you receive from us by email as soon as you receive them. It is your responsibility to inform us of any inaccuracies within fourteen (14) days of receiving the documents. We cannot accept liability if you fail to notify us of any errors within this timeframe.

17. Complaint Procedure

If you have a concern during the Event, please notify Event staff or concierge@deathandcompany.com immediately so we can attempt to address it. Failure to raise a concern while on-site may limit any ability to claim recourse. Any written complaints must be submitted within 14 days of the Event’s end date.

18. Privacy

We respect your right to privacy. Your personal information is handled in accordance with our Privacy Policy. To see how we collect and use your personal information, please review that policy.

19. Your Liability

You agree to defend and indemnify Death & Co, Gin & Luck, Inc., Everyday Travel LLC, and all of their respective owners, members, officers, directors, employees, agents, and successors and assigns from and against any claims, causes of action, demands, suits, proceedings, investigations, losses, damages, fines, penalties, fees, expenses, costs, and any other liabilities of any kind or nature including but not limited to reasonable legal and accounting fees, arising out of or related to:

• Your breach of this agreement or the documents referenced herein
• Your violation of any law, rule, regulation, or guideline
• Your violation, infringement, or misappropriation of the rights of a third party, including any rights of publicity or privacy
• Your use of the Event website
• Your booking or attendance at the Event
• Your negligence or willful misconduct

20. Severability

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. Titles and headings of this agreement are for convenience only and shall not affect the construction of any provision.

21. Successors & Assigns

This agreement shall inure to the benefit of and be binding upon Death & Co, Everyday, and the Participant and their respective heirs, legal personal representatives, successors, and assigns.

22. Applicable Law & Choice of Forum

Any dispute arising out of this agreement, including all tort claims and any dispute relating to bookings or transactions made with Death & Co or Everyday — whether such dispute arises in contract or in tort or otherwise — shall be resolved exclusively by the state and federal courts located in New York, New York, and you agree to personal jurisdiction of those same courts. The laws of the State of New York, USA, govern this agreement.

23. Merger

This agreement is the final, complete, and exclusive statement of the parties’ agreement on the matters contained herein. It supersedes all previous negotiations and agreements.

24. Updates

Death & Co and Everyday reserve the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions prior to booking.
